ConsulNet Computing Inc. (SuccessWebsite.com) Granted Preliminary Injunction Order Against
Web Agent Solutions and Infinity Agent Solutions

Dear Valued SuccessWebsite.com Customer:

Almost four years ago, ConsulNet sued Dynamic Investment Group, Inc. (DIG), which does business online as Web Agent Solutions, and its owner David Moore for improperly taking ConsulNet’s proprietary content and using it to copy and create a competing real estate website business.  On May 1, 2008, in the United States District Court for the Eastern District of Pennsylvania, located in Philadelphia, a federal jury returned a unanimous verdict in ConsulNet’s favor against Mr. Moore and his company.  On June 6, 2008, Judge Louis H. Pollak signed a Preliminary Injunction Order enjoining DIG, Moore and any related entities from soliciting or accepting any further clients, as described below.  The court shortly will be determining financial damages and permanent injunctive relief against Mr. Moore and DIG.  ConsulNet is requesting an award of several million dollars including punitive damages as a result of the defendants' wrongful actions.

The Court's injunction provides as follows:  Dynamic Investment Group, Inc. (DIG), which does business online as Web Agent Solutions and Infinity Agent Solutions, and its owner Megel David Moore hereby are ENJOINED, until further order from the Court, from direct and personalized solicitation, or acceptance, of any further clients for the provision of any real estate website or related product or service if such clients (1) purchased goods or service from either Craig Proctor Productions, Inc., or ConsulNet Computing Inc. [SuccessWebsite.com], or attended a Craig Proctor seminar, since June 1, 2003; or (2) presently maintain a live ConsulNet website.

DIG and Moore also are ENJOINED, until further order from the court, from transferring or facilitating in any way the transferring of any existing clients to the Infinity Agent Solutions website product.

The injunction applies to all clients or customers, whether paying or non-paying.  This injunction also shall apply to any business, trade name, subsidiary, parent, or related entity of Dynamic Investment Group, Inc. and/or Megel David Moore, including but not limited to Web Agent Solutions, Infinity Agent Solutions, Big Blue Marketing, Agent Panel, Agent Panel Elite, Agent Panel Gold and Agent Panel Gold DB. 

In this case, the jury found that Moore breached his contract with ConsulNet by improperly using ConsulNet’s proprietary materials, that the Web Agent Solutions websites infringe upon ConsulNet’s copyrights both under United States and Canadian law, and finally that Moore and his company intentionally and improperly interfered with ConsulNet’s contractual relations with its clients. On the last claim, the jury also found that both Moore’s and DIG’s conduct was “outrageous.” This finding entitles ConsulNet to punitive damages against the defendants.
